DMCA & Copyright Policy

EVsBuzz.com respects the intellectual-property rights of others and expects users of the Site to do the same. In line with the United States Digital Millennium Copyright Act of 1998 (DMCA), the Indian Copyright Act 1957 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, we respond to clear notices of alleged copyright infringement.

1. If your copyright has been infringed

If you believe that material on the Site infringes a copyright you own or control, please send a written notice to our designated agent containing the information below. We will act on properly-formed notices in good faith and without undue delay.

1.1 Required information (DMCA § 512(c)(3))

1. An electronic or physical signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of such works.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate it (e.g. the exact URL on https://evsbuzz.com).
4. Your full name, postal address, telephone number and email address.
5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

1.2 How to send

2. Counter-notification

If you believe material that you posted to the Site was removed or disabled by mistake or misidentification, you may send a counter-notification under DMCA § 512(g) containing:

1. Your physical or electronic signature.
2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your full name, postal address and telephone number, and a statement that you consent to the jurisdiction of the appropriate court and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

On receipt of a valid counter-notification, we may forward it to the original complainant. Unless the complainant files a court action within the period permitted by the DMCA, we may restore the removed material.

3. Repeat infringer policy

In appropriate circumstances and at our discretion, we will terminate accounts and block submissions from users who are repeat infringers of copyright, in line with DMCA § 512(i).

4. Misrepresentation

Under DMCA § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer or by EVsBuzz.com.

5. India — Intermediary Guidelines 2021

In addition to the DMCA process, complaints concerning content alleged to violate the Information Technology Act 2000 or the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 may be sent to the same address. We will acknowledge such grievances within 24 hours and dispose of them within the statutory window, in line with Rule 3 of those rules.

6. Trademarks & image rights

Vehicle model names, manufacturer logos, partner brands and similar marks remain the property of their respective owners. Their appearance on EVsBuzz.com is for editorial commentary, review, news reporting and criticism — uses that are generally permitted under principles of fair dealing/fair use — and does not imply endorsement of EVsBuzz.com by the rights holders.
